We invite you to read our General Terms and Conditions of Sale ("GTCS") before using our website, www.hublot-mode-marine.com (the "Site") and/or making a purchase. Please note that any online purchase implies full acceptance of these Terms and Conditions.

The GCS apply between you, as a consumer and non-professional, and us, the company SGP PRODUCTIONS, a simplified joint stock company, whose registered office is located at lou pont trinquat, 81290 LABRUGUIERE, registered with the Castres Trade and Companies Register under number 519 009 161. Please note that these terms and conditions are subject to change, as we reserve the right to modify them at any time in accordance with changes to the Site and/or regulations. We wish to make it clear that the terms and conditions in force at the time you place your order will apply to you.

This privacy and cookie management policy details SGP Productions' policy on privacy protection, personal data collection and cookies. It applies to data collected on the www.hublot-mode-marine.com website. In order to facilitate access to this charter, we make it available on our home page as well as at any other place where personal information is requested.

The purpose of this charter is to inform you :

- The means we use to collect your personal data, in strict compliance with your rights.

- Data that may be collected on our Site.

- On the use that may be made of the data collected and the rights you have over this data.

- SGP Productions specifies in this charter and/or whenever you are asked to provide personal data, the purposes of the processing as well as the means of any operation (collection, recording, modification...).

SGP Productions undertakes to :

- Ensure compliance with data protection principles,

- Inform people about their rights of access, rectification and opposition.

- Carry out legal and/or regulatory formalities.

We inform you that we comply, in the collection and management of your personal data, with Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms, as amended and in its current version, as well as with the General Data Protection Regulation, adopted on April 27, 2016 by the European Parliament, and the laws and regulations deriving therefrom.

01. YOUR CUSTOMER ACCOUNT.

In order to order on our Site, you can create a customer account via the "Create an account" section or place an order without creating a customer account, as a guest.

Creating your account allows you to :

- to fill in your personal information in order to facilitate your future purchases;

- consult, modify and update your personal information;

- to identify yourself before placing an order;

- track your current orders and view invoices for past orders;

- send a return request ;

If you order as a guest, you will be able to track your order by email.

By ordering on our Site, you confirm that you are a private individual, and that you are purchasing our products for personal use in quantities corresponding to the usual needs of a consumer's household. Under no circumstances may our Site be used by professional sales "customers". We reserve the right to refuse any order that is clearly validated by a professional customer.

You are responsible for maintaining the confidentiality of your customer account and password, and for restricting access to your computer or other equipment. As such, you acknowledge that you are responsible for all activities that occur under your customer account. If you suspect that your customer account is being used by a third party, we recommend that you change your password and contact us to close the usurped customer account, if necessary. 02. HOW TO ORDER ON OUR SITE?

Product offers and prices are valid as long as they are visible on the Site, while stocks last. In the case of special offers, the duration of the offer will be indicated on the Site and in our newsletters. Our products may be temporarily unavailable, and you will be informed of this on the product sheet. 

Ordering is easy!

- Select your items, the desired size, the desired color and add them to the shopping cart. At any time, you can check the number of items in your basket and obtain detailed information on each item by clicking on "Basket". Once you've added an item to your basket, you can continue shopping by clicking on "Continue shopping";

- Once you have completed your basket, click on "Finalize my order";

- Log in to your customer account, create an account if you don't already have one, or continue as a guest;

- Choose the delivery method you prefer and fill in your delivery address;

- Choose your payment method, read and accept the full terms and conditions and proceed to secure payment of your order. Payment of your order implies full acceptance of these terms and conditions;

- Your order has been confirmed! You will receive an email confirming your order.

By placing an order, you declare that you are at least 18 years old and that you have legal capacity (or if you are a minor, that you have parental authorization to place your order).

Once your order has been prepared by us, you will receive an email informing you that your items have been dispatched. You will then be able to track the status of your order using the tracking information contained in the email. If you do not receive an e-mail (either confirming or dispatching your order), please contact us for further information.

We may have to cancel your order for a legitimate reason, for example:

- when you have been able to place an order but your product is no longer available: we will inform you of this as soon as possible and refund the amount of your order as soon as possible;

- when a technical error occurs during payment; 

- when an obvious error has crept into the product data sheet (for example, when there is an error on the essential characteristics of the product, or when an obviously erroneous price is displayed);

- when we observe fraudulent or abusive use of your account or related orders;

- where we reasonably believe that you have breached these GTC.

03. OUR PRODUCT PRICES

The prices of our products are indicated in Euros and include all taxes.

Any financial contribution to processing and/or shipping costs will be expressly indicated to the Customer before the order is placed.

SGP Productions reserves the right to modify its prices at any time. However, products will only be invoiced on the basis of the prices in force at the time each order is registered, as shown on the https://www.hublot-mode-marine.com website.

04. HOW TO PAY FOR YOUR ORDER?

Payment for your order is made directly online by credit card (CB, Visa, MasterCard, American Express).

Once your payment has been confirmed by our payment service provider, your bank account will be debited with the total amount of your order.

We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data with our payment service provider.

At no time do we have access to your personal data concerning your means of payment, in particular your credit card details, and we do not store them on our servers.

However, you may wish to save your bank details in your customer account so that they can be used for future orders. To do so, simply tick the "Save your payment details" box when you make your payment. In this case only, our payment service provider will store your data in encrypted form. You can delete the credit card you have registered either directly in your customer account in the "My payment options" section, or by e-mail by contacting our Customer Service department.

05. DELIVERY OF YOUR ORDER.

5.1 Where and how can you be delivered?

Your orders can be delivered in mainland France (including Corsica) using the following delivery methods:

Colissimo home delivery (3 to 5 working days): €6.45
GLS home delivery (1 to 2 working days): 5.95€ - Free delivery on orders over 120€.
Colissimo point relais delivery (3 to 5 working days): 4.45€.
GLS point relais delivery (1 to 2 working days): 3.95€ - Free delivery on orders over 120€.
You can track the progress of your order as soon as you receive an e-mail confirming shipment, with tracking information.

In the event of absence during the delivery of your order, for home deliveries, you will be given a notice to collect your order.

5.2 When will your order be delivered?

When you place your order, the delivery time for your items will be specified according to the delivery method you have chosen. Please note that delivery times may be longer during busy periods (e.g. Outlets or sales periods).

06. WHAT ARE OUR RETURN, REFUND AND EXCHANGE POLICY?

In order to facilitate the return of your products, we grant you a total period of 30 days from receipt of your order to return your products. You must contact us by telephone on 05 63 75 09 72 from Monday to Friday, 9am to 5pm, or by e-mail via ourcontact form to notify us that you wish to return all or part of your order.

6.1 How do I return my order?

The products you wish to return must be new (the item label must not have been cut off), unworn, undirty and returned in their original packaging.

If our warehouse detects a non-conforming return, our Customer Service department will contact you to inform you of the return of your product.

To make a return, please go to your customer account and click on 'my orders'.
- You will be charged €3.95 for the return of one or more items from your order.
- Once the return has been validated by our customer service department, a prepaid colissimo return label will be sent to you by e-mail.
- Only returns by post are possible (store returns are not authorized).

- Stick the return label on the parcel.

- Drop off the parcel at your nearest colissimo point (Find a point) within 30 days of receipt.

6.2 When will you be reimbursed?

Once your return has been verified by our services, you will receive an email confirming your refund.

We undertake to refund you the amount corresponding to the product(s) returned as soon as possible and at the latest within 14 days following the date of receipt of your return in our warehouses, or the provision of proof of shipment of your return.

In addition, if you decide to opt for a different delivery method that differs from the one we offer, you will be responsible for all costs related to this delivery method.

Your refund will be made directly to the account linked to the credit card used to pay for the order. You will receive an email confirming your refund once it has been validated by our systems. You can follow the progress of your return directly in your customer area, under the heading "My orders", or under the heading "Order tracking" if you placed your order as a guest.

Any product returned that is not new (the item label must not have been cut off), worn and/or soiled and/or damaged and/or missing its label will be returned to you and will not be reimbursed.

07. WHAT GUARANTEES DO YOU OFFER FOR YOUR PRODUCTS?

Our products are covered by legal guarantees, i.e. the legal guarantee of conformity and the guarantee against hidden defects. In our capacity as seller, we are obliged to :

defects in conformity of the products you purchase, under the conditions of article L.217-4 et seq. of the French Consumer Code. The legal warranty of conformity applies when your product has a defect of conformity, for example when your product does not function in accordance with its usual use, or when it does not correspond to the description given;

and its hidden defects under the conditions of article 1641 et seq. of the French Civil Code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. a defect not apparent at the time of sale which makes the product unsuitable for its intended use, or which considerably reduces that use.

Please note that the legal guarantee of conformity and the guarantee against hidden defects will not be applicable in the event of misuse of your products or failure to comply with the maintenance conditions for your product (provided on our labels or by our reworkers).

If you are claiming under the legal warranty of conformity, you :

have a period of six (6) months from delivery of the product to take action;

may choose between repairing or replacing the product, subject to the cost conditions stipulated in Article L.217-9 of the French Consumer Code;

are exempted from proving the existence of the lack of conformity of the good during the twenty-four (24) months following the delivery of the good, except for second-hand goods for which the period is six (6) months.

The legal warranty of conformity applies independently of any commercial warranty.

You may decide to invoke the warranty for hidden defects as defined in article 1641 of the French Civil Code. In this case, you may choose between rescinding the sale or reducing the purchase price in accordance with article 1644 of the French Civil Code.

We treat your Personal Data with the utmost care and confidentiality.

10. RESPONSABILITÉ ET FORCE MAJEURE.

We undertake to describe the products we sell on the Site as accurately as possible and to keep the information published on the Site as up-to-date as possible.

We shall not be held liable in the event of a breach of any of our contractual obligations resulting from a case of force majeure as defined by law. In particular, we shall not be held liable for any non-performance or delay in the execution of your orders, caused by events beyond our control, such as :

  • Strikes, closures or other industrial actions ;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disasters;
  • Inability to use rail, sea, air, road or other means of private or public transport;
  • Inability to use public and private telecommunications networks;
  • Acts, decrees, legislation, regulations or restrictions issued by any government (e.g. administrative closure of stores);
  • Failure or accident of maritime, postal or other transport.

The performance of the GTC will be suspended for as long as the force majeure lasts, and performance and delivery times will be extended accordingly. Please note, however, that we will do our utmost to put an end to the case of force majeure or to find a solution enabling us to perform our contractual obligations despite the case of force majeure.

11. RÈGLEMENT DES LITIGES.

The present general conditions of sale and the contractual relations between SGP Productions and the consumer are subject to French law.

In the event that one of the clauses of these General Terms and Conditions of Sale should be null and void by virtue of a legal or regulatory provision, or a court decision, the other clauses shall continue to apply.

Any dispute relating to the interpretation, performance or termination of these general terms and conditions of sale and/or the contractual relationship between SGP Productions and the consumer shall be submitted to the sole jurisdiction of the French courts, notwithstanding multiple defendants and/or third-party claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition. The competent court in the event of litigation will be that of the defendant's domicile.

In the event of a dispute arising from a sale, the customer may submit a written complaint to Customer Services via our contact form.

In the event of a complaint not amicably resolved by Customer Services, the customer may, for a period of one (1) year, have recourse free of charge to the mediation service CNPM Médiation Consommation, of which SGP Productions is a member. You can submit your complaint on its website: https://cnpm-mediation-consommation.eu or by post: 27, avenue de la Libération 42400 Saint-Chamond, in accordance with articles L. 612-1 and R.616-1 of the French Consumer Code. The Ombudsman Service may be contacted for any consumer dispute which has not been settled amicably.
